Cancellation, Termination and Refunds of Web Hosting Accounts
All web hosting accounts are for a period of one calendar year from the date of ordering or renewal. From Year Two fees are charged on an annual pre-pay basis and are non-refundable. As of 2008-2009 the charges are £40 (GBP sterling) for a 2-4 page site, £55 (GBP sterling) for 5-11 pages and £65 (GBP sterling) for up to 12 pages. All of this is for the use of web space and reasonable bandwidth; Museltof Web Design will continue to apply any required monthly edits for free.
From Year Two, account holders may terminate their accounts simply by not renewing them. Failure to use or renew an account is deemed to be a termination of customers choice. No refund will be given where customers terminate or cease to use their account prior to the end of the term of the hosting account period.
In the event that Museltof Web Design finds an account is in breach of the prohibited uses (for example using a designed web site as a base for sending out spam (completely unsolicited sales-based e mail on a large level), then that account may be terminated without notice. No refund for the remainder of the year will be given.
All web sites use bandwidth. There is normally absolutely no problem here with the small web sites which we design and set up, but we do keep a note of bandwidth. If your web site becomes world-famous overnight, bandwidth will surge and we may suggest that the bandwidth is too heavy for our servers and that you might wish to move it elsewhere. In such a very rare case (it has never happened and, frankly, is unlikely to), we would still not cancel your account/website without notice and you would be entirely free to move our design elsewhere. Once we set up your web site, the material on there becomes your copyright.
UK Customers Only: Under the terms of The Consumer Protection (Distance Selling) Regulations 2000, consumers have a "cooling off" period of 7 working days from the date that the order is placed in which they may cancel orders placed by distance contract. However, this right to cancel does not apply where service provision begins before the end of the cooling off period. All web hosting accounts provided by Museltof Web Design begin the same day that the order is placed, normally within 2 hours of receiving your design payment we will be designing your new website. Therefore, the consumer's right to cancel and receive a full refund will not apply once service provision has begun. Commencement of service will normally be considered to be the time at which your account activation commences and we are designing.
The Consumer Protection (Distance Selling) Regulations 2000 do not apply to business-to-business transactions, nor to transactions with businesses or consumers based outside the UK.
Liability
Museltof Web Design will NOT be responsible for any loss or damage your business may suffer. We make no warranties, expressed or implied, for any services we offer. If our Site Ground server goes down (their system is one of the most highly reliable on the internet), it is not our fault and it will affect many thousands of web sites, not only yours.
Customers shall indemnify and hold harmless Museltof Web Design from any and all demands, liabilities, losses, costs, and claims, including all legal fees, asserted against us and our agents, customers, officers and employees, that may arise from any service provided or performed or agreed to be performed. Museltof Web Design will assuredly NOT be responsible for any loss or damage caused by infringement of copyright or proprietary rights, supply of defective goods or services, any loss or damage (personal or business), caused by any parties whatsoever. We will listen to your suggestions in setting up your website but the customer - NOT US - is responsible if certain claims suggested by the customer are subsequently found to infringe copyright.
We DO NOT set up music-downloading sites, large photograph gallery sites, and most certainly not pornographic sites.
Ongoing Site Editing
I will edit, oversee and maintain any site which we design. This is because the site will be hosted by us. This editing, however, can only be done on a monthly basis, not a day-by-day basis. So the customer should keep a list of required monthly edits and let us have them once per month. If, however, something comes to light which is due to an error caused by us, it will be rectified immediately that we are made aware of it.
Changes and Amendments
Museltof Web Design reserves the right to amend and/or change these Terms and Conditions without notice.
